Safety screening policy updates for 1 July 2021

The Safety screening policy for funded organisations (as listed in the Service Agreement Requirements) was issued on 1 January 2020 as part of the 2020-2024 Service Agreement.

The policy now includes two updates, effective 1 July 2021, which includes a legislative change and a clarification of the existing disclosable outcomes process.

The addition of the disclosable outcomes section is in response to queries to the Service Agreement Performance Branch from funded organisations about when they need to notify the department.

The policy fundamentally remains unchanged.

  • Legislative updates – new Worker Screening Act 2020 and Working with Children Clearance (which on 1 February 2021 replaced the Working with Children Act 2005). It does not alter the way Working with Children Clearance (previously ‘Checks’) are undertaken.
  • Disclosable outcomes – new section to clarify when an organisation is required to notify the department where a police check has an adverse disclosable outcome. This notification is based on program requirement of the funded activity. If there is no program requirement, the organisation is not required to notify the department. 

Notice of updates: As part of the contractual arrangements of the 2020-2024 Service Agreement, the department is required to provide 20 business days’ notice to funded organisations of any new, amended or replaced applicable departmental policy, standard or activity description. In meeting this obligation, the department advised all funded organisations on 2 June 2021 about the updates to this policy, via the Funded Agency Channel.

The updated policy will be available online on the Funded Agency Channel on 1 July 2021, when it becomes effective.
